1. About this policy
Kimmy Stevens Photography (“we”, “us” and “our”) respects your privacy. This policy explains how we collect, use, store and disclose personal information when you visit our website, enquire about or book photography, participate in a session or event, purchase products, or otherwise deal with us.
We handle personal information in accordance with applicable Australian law. The Privacy Act 1988 (Cth) and Australian Privacy Principles apply to some, but not all, small businesses; where they apply to us, we comply with them.
2. What information we collect
We may collect:
names, contact details and correspondence from clients and people who contact us; booking and shoot details, including dates, locations, requested services, preferences and information you choose to tell us about people to be photographed; photographs and other images we create, receive or deliver, which may identify you, your family, guests or other people; order, invoice and payment information (payment card details may be processed by a separate payment provider); information needed to arrange access to venues, coordinate suppliers, fulfil print or album orders, and deliver galleries; marketing preferences; and website information such as IP address, device or browser details, pages viewed, referral information and cookie identifiers.
Some images or details you provide may reveal sensitive information, such as health information, cultural background or religious beliefs. Please tell us only what is relevant to your photography needs. We will handle such information with particular care and seek consent where required by law.
3. How we collect information
We collect information directly from you through enquiries, forms, bookings, questionnaires, emails, calls, purchases and photography sessions. We may also receive information from someone arranging a booking on your behalf, a venue or planner, a person sharing gallery access, or other suppliers involved in your booking. Our website may automatically collect technical information through cookies and similar tools.
If you provide information about another person, including a child or guest, please ensure you are authorised to do so and share this policy with them where practical. We may photograph people at a booked event or session in accordance with the arrangements made with our client and applicable law.
4. Why we use information
We use personal information to respond to enquiries; prepare quotes and agreements; plan, photograph and manage sessions and events; edit and deliver images; operate online galleries; fulfil products and payments; provide support; maintain business records; secure and improve our website and services; send marketing where permitted; and comply with legal, tax, accounting and insurance obligations.
Use of a photograph in our portfolio, website, social media or other promotion is governed by the permissions and arrangements applicable to the booking. Contact us if you have a question about how an identifiable image may be used. We do not treat your booking alone as blanket consent for every promotional use.
5. Cookies and analytics
Our website may use essential cookies and other technologies for functionality, security, analytics or advertising measurement. These may collect information about your visit and interactions. You can manage cookies through your browser and any controls offered on the website; disabling them may affect some features.
6. Marketing
We may send updates or offers where you have consented or we are otherwise permitted to do so. Marketing emails and messages will identify us and provide an unsubscribe method where required. You may also opt out by emailing hello@kimmystevensphotography.com. We may still send messages needed to manage a booking, order or service.
7. Who we share information with
We may share information with providers who help us run the website, manage enquiries and bookings, process payments, store and edit photographs, host and deliver galleries, fulfil albums or prints, send communications, provide analytics or advertising services, and manage accounting and IT. We may also share relevant details with second photographers, assistants, venues, planners and other suppliers involved in a booking, or with professional advisers, insurers and authorities where appropriate or required by law.
Recipients of gallery links may be able to view, download or share images depending on the gallery settings. Please consider who receives a link and contact us if you need help with access settings. We do not sell personal information for money.
8. Overseas storage and disclosure
Some providers may store or process information outside Australia. Where applicable law requires, we take reasonable steps in relation to overseas disclosures.
9. Security and retention
We take reasonable steps to protect information from misuse, loss and unauthorised access, including suitable access controls and security measures for our systems and service providers. No online transmission or storage method is completely secure.
We keep information and images for as long as reasonably needed to deliver services, administer our business, resolve disputes and meet legal obligations. When no longer required, we take reasonable steps to delete or de-identify personal information where practical and lawful.
10. Children
Our photography services may involve children. A parent, guardian or another authorised person generally arranges a child's session or provides relevant information. We take care when handling children's information and images. If you have a concern about a child's image or gallery access, contact us.
11. Access, correction and complaints
You can ask to access or correct personal information we hold about you, or raise a privacy concern, by emailing hello@kimmystevensphotography.com. We may need to verify your identity. We will consider your request and respond within a reasonable period, subject to applicable law and the rights of other people appearing in images.
If the Privacy Act applies to us and you are dissatisfied with our response to a privacy complaint, you may be able to complain to the Office of the Australian Information Commissioner at https://www.oaic.gov.au.
12. Data breaches
We assess suspected data breaches and take appropriate steps to contain and respond to them. Where the Notifiable Data Breaches scheme applies, we will notify affected people and the OAIC when required by law.
13. Other websites and updates
Our website or galleries may link to third-party services. Their privacy practices are governed by their own policies. We may update this policy as our services or practices change and will show the revised date on the website.
